This End User License Agreement (this “Agreement”) sets forth and governs your access to and use of the My Roehl application downloaded or otherwise acquired by you along with associated documentation (collectively, the “Application”).

By downloading, installing, or otherwise using the application, you acknowledge and agree to be bound by its terms and conditions.  If you do not agree to the terms of this Agreement, do not download, install, or use the Application.

Application License

Pegasus grants to you a limited, non-exclusive, and nontransferable license to use the Application strictly in accordance with the Application’s documentation and this Agreement. This includes any changes, modifications, deletions, or other updates (“Updates”) to the Application. 

Prohibited Uses

You agree to comply with all applicable laws, rules, and regulations in connection with your access and used of the Application.

You shall not: (i) copy the Application, except as permitted by this Agreement, (ii) modify, translate, adapt, or otherwise create derivative works or improvements of the Application, (iii) reverse engineer, decompile, disassemble, or otherwise attempt to derive the source code of the Application or (iv) attempt to gain unauthorized access to any other account, computer system, or network connected to any Pegasus server.

No Warranties

Pegasus expressly disclaims any warranty for the Application. The Application is provided “as is” without warranty of any kind, either express or implied, including, without limitation, the implied warranties of merchantability, fitness for a particular purpose, or noninfringement.  The entire risk arising out of use or performance of the Application remains with you.

Intellectual Property

The Application and any Updates and the content thereof (including, without limitation, copyrights, trademarks, service marks, trade names, logos and other proprietary materials) are the intellectual property of, and all rights, title and interest therein and to the Application are owned exclusively by, Pegasus or its licensors. The structure, organization, methods, and code of the Application are the valuable trade secrets and confidential information of Pegasus. The Application is protected by copyright and international treaty provisions. Except as expressly stated herein, no other rights are granted to you by implication, estoppel, or otherwise, under any patent, copyright, trade secret, trademark, or other intellectual property right. 

No Liability for Damages

In no event shall Pegasus be liable for any special, consequential, incidental or indirect damages whatsoever (including, without limitation, damages for loss of business profits, business interruption, loss of business information, or any other pecuniary loss) arising out of the use of or inability to use this product, even if Pegasus is aware of the possibility of such damages and known defects.
